Which Traffic Ticket’s Affect My Commercial Driver’s License (CDL)
Va Code §46.2-341.20 is the Virginia version of Part §383.51 of U.S. Department of Transportation Federal Motor Carrier Safety Administration Rules.
If a Commercial Driver’s License Holder (CDL) commits:
- two serious traffic offense they will lose their CDL for 60-days.
- three serious traffic offenses they will lose their CDL for 120-days.
The following traffic tickets are “serious traffic offenses”
- Speeding 15 mphs over the limit or faster
- Reckless Driving
- Fatal traffic accident arising from a traffic control violation
- Improper lane change or following too closely
- Following too closely
- Texting while driving in a Commercial Motor Vehicle (CMV) [Va. Code § 46.2-1078.1]
- Talking on the phone while driving in a Commercial Motor Vehicle (CMV) [Va. Code § 46.2-1078.1]
